Not respecting &since_id

I am trying to setup a system to grab recent tweets periodically, but the since_id parameter doesnt work, so I always get the same few recent tweets

I dont want to get the same tweet more than once

I call
curl http://search.twitter.com/search.atom?q=mysearchterm&since_id=170864859213344768
the since_id is the previously returned max_id.

However it just gives me the same results over and over, seems to be the same with .json as well.

Any ideas ?

We do have a bug we areinvestigating where at times instead of a result set ending when it should, it loops around again. This sounds like it may be that bug.
